Providing information on a breach

Pursuant to the Law of the Republic of Lithuania on the Protection of Whistleblowers and the Rules for the functioning of the internal whistleblower channel  (hereinafter referred to as the Rules) of ABP APRANGA (hereinafter referred to as the Company), the possibility to report a violation through the internal whistleblower channel is provided to any of the following persons seeking to protect the public interest who are or have been connected with the Company or its subsidiaries by: employment, contractual relations (consultancy, contracting, sub-contracting, internship, apprenticeship, volunteering etc.), employment or any other pre-contractual relationship, as well as a self-employed person, a shareholder or a person belonging to the administrative, management or supervisory body of the Company (including non-executive members as well as volunteers and trainees, whether or not remunerated), or any natural person working under the supervision and direction of contractors, sub-contractors and/or suppliers.

Information through the internal channel may only be provided on breaches concerning  danger to public safety or health, life or health of a person; environmental hazards; financing of unlawful activities; illegally acquired assets; violation of international sanctions implemented in the Republic of Lithuania or of restrictive measures established by the laws of the Republic of Lithuania; as well as any other breaches provided for by the Law on the Protection of Whistleblowers of the Republic of Lithuania.

Please note that this internal channel is intended only for information on breaches indicated in the Law of the Republic of Lithuania on the Protection of Whistleblowers and not for complaints about the quality of goods or services or for requests related to the defense of purely personal interests.

The person providing information on a breach shall provide the information by completing the Breach Notification Form  or by submitting a free-form notification containing the information required by the Law of the Republic of Lithuania on the Protection of Whistleblowers and the Rules and submitting it through the Company's internal channel: [email protected]. The internal channel shall be administered by the team of responsible persons appointed by order of the General Manager.

The procedure for reporting and handling breaches through the Company's internal channel is clearly set out in the Rules. 

The legal remedies of the person who has provided information about the breach which protect against adverse effects of the measures are provided for in Article 11(3) and (5) of the Law of the Republic of Lithuania on the Protection of Whistleblowers.

The rights and guarantees of the whistleblower and exemption from liability for disclosure are provided for in Article 3(3) of the Law of the Republic of Lithuania on the Protection of Whistleblowers.

Please note that the Criminal Code of the Republic of Lithuania establishes criminal liability for falsely implicating an innocent person in the commission of a criminal offence or for reporting an offence that is not known to have occurred.
